Analisis Terhadap Kelalaian Pemenuhan Nafkah Anak Pasca Putusan Pengadilan Agama Gorontalo

Abstract

This study aims to reveal the effectiveness of the implementation of the decision and the factors that cause negligence in fulfilling the child's maintenance after the decision of the Gorontalo Religious Court. As for the research method used this type of research, which is used is qualitative with an empirical juridical approach, while the primary data source, namely the Judges and Registrars who are considered directly related to this research. Several research instruments used in collecting data in this study are: 1) Document Study, 2) Observation, 3) Interview. The results of the study revealed that: 1) The judge's decision regarding the maintenance of children after the divorce of parents which has legal force is still not effective and able to fully bind the responsibility of imposing child maintenance on a father, so that many male parents often neglect to provide maintenance to her children. 2) Factors that cause negligence in fulfilling child maintenance after the Ruling of the Class 1A Gorontalo Religious Court are the husband's economic factors, the lack of a sense of responsibility, the community's understanding of efforts to execute children's maintenance.
